It is true that, in theory, the same insurance coverage that exists for Uber accidents should also apply for accidents involving UberEATS. But this is only in theory, because it gets more confusing than that.

Uber, the regular ridesharing app in California, offers insurance coverage for both its drivers and customers. If you are not familiar with it, here are the basics:

  • After a ride has been accepted by the Uber driver and/or the Uber driver is in the middle of a trip, transporting passengers. Uber offers $1 million of liability insurance for each Uber accident and another $1 million of uninsured or underinsured motorist insurance benefits for each accident involving an Uber vehicle (the coverage is available to the driver and passengers).
  • The Uber app is on but the driver is not carrying passengers at the time. In that situation, Uber offers $50,000 for each person in the accident and $100,000 for each accident as well as $25,000 of property damage coverage.
  • Passengers are in the vehicle. If an Uber passenger is in the car and an accident occurs, Uber may make the comprehensive/collision insurance available.

What UberEATS insurance coverages are available

How to recognize an UberEATs vehicle?

While it may seem that recognizing an UberEATS vehicle may be easy (most of them have stickers on the windows), it is not necessarily so. Here is the thing: finding out if UberEATS was involved in your car accident is tough for a variety of reasons.

First of all, not all UberEATS vehicles are marked. Second of all, not all UberEATS drivers want to admit that they were driving for UberEATS to avoid insurance problems and out of fear that Uber could suspend them from accepting future food delivery orders because of the accident.
